Privacy Policy

This Privacy Policy (this “Policy”) is intended to describe how Waev Data Inc. (“Waev”) uses information that you provide, either directly or indirectly, using Waev’s software (the “Software”). By using the Software, you are entering into a legally binding agreement with Waev that includes this Policy, which is a part of Waev’s Terms of Use (“Waev’s Terms”). A copy of the Terms of Use can be accessed by clicking or tapping on http://waevdata.xyz/terms. Waev’s Terms govern your access to and use of the Software. Please read Waev’s Terms carefully and completely BEFORE you use the Software. Your accessing and use of the Software assumes that you accept Waev’s Terms and that you promise to comply with Waev’s Terms.

By using the Software, you are consenting to our collection, storage, use and processing of any information that you provide to us via the Software or that you cause, or allow, to be provided from third parties to us via the Software and acknowledging that you have the right to cause, or allow, each such third party to provide any such information to us.

How is the information stored?
Because the Software uses the blockchain and other distributed ledger technologies to assemble, store and share consumer data, this information is stored among your and third parties’, and not on our, computer, network and/or other systems. Some distributed technologies may permanently retain data in accordance with its design even after the use of the Software has ended. The Software does, however, create unique identifiers to help manage and control the Information so that the manner in which it is shared with, and used by, third parties can be managed and controlled via the Software.

What Information do we collect and how is it used?
We collect the information you provide directly via the Software and/or that you cause, or allow, to be provided to us from third parties via the Software. If you use the Software to contact us, we may also collect your name, e-mail address, telephone number, the particulars of your communication and any other information requested by us, or provided by you, in doing so. We may also collect information you provide or make available if you interact with our publicly facing websites (e.g., our website or any social media activity), receive regular emails from us (e.g., newsletters, bulletins, etc.) and/or participate in other activities we offer that request you to provide Information.

We may also collect information about the computer, network and/or other systems you are using to access the Software, including the type, operating system, device settings, device identifiers and crash data. Whether we collect some or all of this information often depends on the type of computer, network and/or other systems you are using and its settings. To learn more about the information your device makes available to us, please review the policies of your computer, network and/or other systems manufacturer or software provider.

If you allow your location data to be provided, we may collect it. If you choose not to provide your location data to us, you may not be able to use all of the Software’s features.

We may collect non-personally identifying information of the sort that web browsers and servers typically make available, such as the browser type, language preference, the prior and/or referring website and the date and time of each visitor request when visitors use the Software. Our purpose in collecting this information is to better understand how our visitors use the Software and we may release non-personally identifying information in the aggregate.

We may also collect potentially personally identifying information like Internet Protocol (IP) addresses and statistics about the behavior of visitors to the Software and may analyze these statistics to monitor the Software’s performance. This potentially personally identifying information could also be used to identify your online activities over time and across third-party websites or other online services (sometimes referred to as behavioral tracking).

We may use third-party services (e.g., Google Analytics, etc.) to collect, monitor and analyze the information you provide to us in order to increase the Software’s functionality and/or connect such information to information about you that we collect from these third-party services. Your provision of information to those third parties is subject to their privacy policies.

All of the information you provide to us, or we collect from you, is referred to in this Policy as “Information”.

How do we use your information?
The information may be used for the following purposes: (1) to provide and improve the Software, (2) to administer your use of the Software, (3) to better enable your use and navigation of the Software, (4) to better understand your needs and interests, (5) to fulfill requests you may make, to respond to questions you may ask or to respond to comments you may make, (6) to personalize your experience, (7) to provide you with announcements, notifications and/or advertisements related to your interests and use of the Software, (8) to provide electronic newsletters, promotional e-mails or similar messaging and communications, (9) to provide service announcements, (10) to protect against users seeking to misuse and/or hack into the Software and (11) to assess the level of general interest in the Software.

With which third parties do we share Information?
In addition to as describe above “How is the information stored?”, we may share Information with certain third parties such as our agents, service providers and other representatives acting on our behalf. For example, we may share Information with third parties to perform services on our behalf such as those (1) providing you access to the Software, (2) fulfilling your requests, (3) administering your account, (4) sending marketing communications or (5) conducting other business activities as needed.

The third parties with whom we conduct business are authorized to use your information only to perform the service for which they are hired. They are required to abide by the terms of our Privacy Policy, including taking reasonable measures to ensure Information is secure. On occasion, we contract with trusted third-party providers who would receive Information and conduct anonymized aggregate analyses of the data. Through our contractual arrangements, we require our contracting partners to maintain adequate security of Information provided to them. We do not permit such third parties to sell Information to other third parties.

We may disclose non-personally identifiable aggregated information about our users without restriction.

Other than to its employees, contractors and affiliated organizations or as described above, we disclose personally identifying information only when required to do so by law, or when we believe in good faith that disclosure is reasonably necessary to protect our, your, a third parties’ or the public’s rights.

If you send us a request (for example via support request), we may publish it in order to help us clarify or respond to your request or to help us support other users. We may also disclose your personally identifying information if you expressly consent to the disclosure.

Will you sell Information?
We do not, to the best of our knowledge, sell or rent Information that we have collected or retain about you to any other third-party for any purpose. Accordingly, we do not offer individuals the ability to “opt-out” of the selling or renting of Information because we do not engage in those practices.

If substantially all of our assets are acquired, whether via third-party sale or judicial process (e.g., bankruptcy), Information would be one of the assets that is transferred to, or acquired by, a third party and any such third party would then be entitled to use Information as set forth in this policy.

For how long is data retained?
The period during which we store Information varies depending on the purpose for the processing. For example, we may store Information to facilitate transactions you have requested for so long as you are using the Software. We store Information for marketing purposes until you have opted-out of receiving further direct marketing communications in accordance with applicable law. In all other cases, we store Information for as long as it is needed by us to fulfill any arrangement between us and you. After any such arrangement is satisfied or terminated, Information is either anonymized (where permitted by applicable law), deleted or destroyed.

How are cookies and other analytical tools used?
We use cookies and/or web beacons to identify and organize Information, to recognize those computer, network and/or other systems accessing the Software, to remember your preference settings and to help us enhance the usability and performance of the Software, to count the number of users who have visited specific pages within the Software and/or to determine whether or not communications we deliver have been opened and/or acted upon.

The type of cookie or similar technology that may be used by the Software can be categorized as follows:

  • Strictly Necessary Cookies. These cookies are essential for basic functionalities of the Software, and they enable you to move around the Software and use its features, particularly in connection with information searches and order placement. Without these cookies, the Software would not be fully functional. These cookies do not gather information about you that could be used for marketing or remembering where you have been on the internet. Examples of strictly necessary cookies are a shopping basket cookie, which is used to remember the products that you wish to purchase when you add products to your shopping basket or proceed to checkout, a login/ authentication cookie which allows and manages your login to the Software and identifies you after logging in for a single session, a session cookie which is required to carry out the data transmission and provide the Software to you, a security cookie that detects repeat failed login attempts or similar abuses of the Software. These types of cookies are regularly stored only as long as required for their purpose.
  • Performance Cookies. These cookies collect information about how you use the Software (e.g., which pages you go to most often and if you get any error messages from certain pages). These cookies collect information that is used to improve how the Software. Without these cookies, we cannot learn how the Software is performing and make relevant improvements that could better your browsing experience.
  • Functionality & Profile Cookies. These cookies allow the Software to store information that you provide, such as preferences, and to store technical information useful for your interactions with the Software. For instance, they remember your username and elements of your user profile. They also ensure that your experience using the Software is relevant to you. They may also be used to provide features specific to your account. These cookies will not be used to track your browsing activity on other websites. Without these cookies, a website cannot remember choices you have previously made or personalize your browsing experience. For example, we use cookies to store your language preferences, which allows us to present you with search results in the correct language.
  • Advertising Cookies and Similar Technologies. These cookies or similar technologies may be used to deliver advertisements that are more relevant to you and your interests. They may also be used to limit the times you see an advertisement as well as help to measure the effectiveness of the advertising campaign. These cookies may track your visits to other websites. Without these cookies or other technologies, online advertisements you encounter will be less relevant to you and your interests.

You can likely modify your browser settings to decline the use of cookies and you can withdraw your consent at any time by modifying the settings of your browser to reject or disable cookies or by opting out of specific cookies through the opt-out options shared below. If you choose to decline the use of, reject or disable cookies, you may not be able to use all of the Software’s features.

Some web browsers may transmit “do-not-track” signals to the Software. Because of differences in how web browsers incorporate and activate this feature, it is not always clear whether users intend for these signals to be transmitted or whether they even are aware of them. We currently do not take action in response to these signals.

What are your rights in the Information?
All right, title and interest in and to the Information is and will remain the exclusive property of you and your licensors except as otherwise set forth in Waev’s Terms. By using the Software, you acknowledge that the Information is accurate, reliable and relevant to our relationship, that you have the right to provide, or make available, the Information to us and that so providing, or making available, the Information will not violate any applicable law.

You may have certain rights under applicable data protection law with respect to the Information. To exercise any of these data privacy rights, please contact us in accordance with the “Contact Us” section listed below. By doing so, you acknowledge that you are authorized to act with respect to such Information. In response, we will respond to any such requests as (and if) required by law and may charge a fee to facilitate your request where permitted by law.

You have the right to opt-out of receiving electronic direct marketing communications from us. All electronic direct marketing communications that you may receive from us, such as e-mail messages, will give you an option of not receiving such communications from us in the future.

Certain parties may have additional data privacy rights, including the following:

  • Right to Know. The right to know about what Information we collect about you, and our intended use of, and purposes for collecting, Information. The Information that we collect from you, the purposes for which it is used, the source of such Information, and the parties to whom we share Information, among other issues, are set forth in this Policy.
  • Access. The right to access general categories and/or the specific pieces of Information we have collected, used, disclosed or sold about you over the past twelve (12) months, including the sources from which the Information was collected, the business or commercial purpose for which Information was collected, used, disclosed or sold and the third parties with whom we have shared Information.
  • Deletion/Erasure. The right to request that we delete/erase Information under certain circumstances.
  • Data Portability. The right to request that we transfer, to the extent technically feasible, Information in certain forms and formats.
  • Nondiscrimination. The right not to be subject to discrimination for asserting your rights.

To exercise any of the data privacy rights set forth herein, please contact us in accordance with the “Contact Us” section listed below. By doing so, you acknowledge that you are authorized to act with respect to such Information. If you make any request related to Information, Waev will ascertain your identity to the degree of certainty required under applicable law before addressing your request. Waev may require you to match at least three pieces of Information we have previously collected from you before granting you access or otherwise responding to your request and, if applicable, written documentation that demonstrates a third party is authorized to serve as your agent for the purposes of submitting the requests set forth herein. None of these rights is absolute and each is subject to legal and regulatory exceptions and exemptions.

European Union (EU) Privacy Disclaimer.
Waev processes Information in accordance with the legal bases set forth in the EU General Data Protection Regulation (GDPR) or EU Member State law. For example, our processing of Personal Data on individuals (as described above) is justified based on statutory provisions that (1) processing is based on the consent; (2) processing is necessary for Waev’s legitimate interests as set out herein; and (3) processing is necessary for the performance of a contract to which you are a party. If you are in the EU or afforded protection under the GDPR, you may have certain rights with respect to the Personal Data. To the extent permitted by applicable data protection laws, you may access the Personal Data we hold about you; request that inaccurate, outdated, or no longer necessary information be corrected, erased, or restricted; and, request that we provide your Personal Data in a format that allows you to transfer it to another service provider. You also may withdraw your consent at any time where we are relying on your consent for the processing of your Personal Data. You may object to our processing of your Personal Data where that processing is based on our legitimate interest. You have the right to lodge a complaint with your competent data protection authority. Nevada Privacy Disclaimer.
Pursuant to Nevada law, a Nevada “consumer” (as the term is defined therein), may, at any time, submit a verified request through a designated request address to an “operator” directing the operator not to make any sale of his or her Information that the operator has collected or will collect about the consumer. For clarity purposes, Waev does not sell or exchange Information for monetary consideration to a third party for the third party to license or sell the information to additional persons or parties.

How can this Policy be changed?
This Policy was last revised on August 5, 2022. We may revise this Policy at any time. If we deem such revisions to be material, we will notify you that such revisions were made. If you do not wish to be bound by any such revision, you must terminate in accordance with Waev’s Terms. By using the Software after such revisions become effective, you agree that they apply to your use of the Software and that you are bound by this Policy, as so revised.
